Standard Terms and Conditions of Trading
These terms form the basis of the contract between our customer and Mr Bun The Baker Giltrows Ltd. These Terms, your Order and your Order confirmation are considered by us to set out the whole agreement between you and us for the sale of cakes. It is your responsibility to check all details in the order confirmation are complete and accurate as this is the document we work to when completing your order.
Basis of Sale
Quotations are valid for a period of 3 working days from the day of issue. Cake sizes quoted are in inches and are based on the diameter of the cake. Diameters are chosen depending on the number of servings required. No order is made with you until we have received your booking fee.
The Cakes
We warrant that on delivery or collection the Cakes shall conform to their description as set out in the Order Confirmation, be of satisfactory quality and comply with all food safety, statutory and regulatory requirements in the UK. We will not be held responsible for customer disappointment of the design or the interpretation of the cake as long as it is made in line with the customer’s pre agreed requirements set out in the order confirmation and will face no consequent liability. It is the customers responsibility to ensure all details within the order confirmation meet their exact requirements.
The warranty does not apply to any defect in the Cakes arising from wilful damage, accident, negligence by you or any third party, if you use the cake in a way we do not recommend, your failure to follow our instructions or any alterations you carry out.
Our cakes are made in an environment where Gluten, Eggs, Lupin, Milk, Mustard, Nuts, Peanuts, Sesame Seeds, Soya and Sulphur Dioxide are present. We produce the cakes on a premises where allergens are handled by our staff and where equipment and utensils are used for multiple items, including those containing allergenic ingredients. Although we do our best to prevent it, there is still a chance food may have come into contact with other allergens.
We cannot guarantee an exact replica of any cake, but we will do our best to make it so. Exact colour matches are not guaranteed. Stacked cakes contain dowels in each tier to provide support and these should be removed before consumption. It is advised that cakes containing large sprinkles, models or toppers are removed before consumption.
The cake is a fresh product and it is our right to assume consumption on the day requested. Cakes containing Jelly, Fruit or Fresh Cream must be refrigerated and consumed within 24 hours. Buttercream cakes should be consumed within 3-5 days. Cover the exposed cake with clingfilm or place in an air tight container. If you have lots of leftovers, wrap slices of cake tightly and freeze for up to one month. Buttercream cakes (not containing Jelly, Fruit or Fresh Cream) can be stored in a cool dry place, away from direct sunlight and sources of heat in the box provided. However, refrigeration is recommended especially in warmer months.
Fresh flowers used on cakes are made food safe with the use of floristry tape. They must all be removed before consumption, so please ensure each stalk has the tape attached. The flowers are cut just before your collection/delivery to ensure longevity but are likely to wilt after 24 hours so please bare this in mind when ordering.
Mr Bun The Baker Giltrows Ltd and the customer expressly agree that the cakes and all goods purchased from Mr Bun The Baker Giltrows Ltd remain the property of Mr Bun The Baker Giltrows Ltd until paid for in full.
Delivery and Collection
All orders may be collected free of charge from Mr Bun The Baker Giltrows Ltd by prior arrangement. When transporting your cake, hold the box level and from the bottom. You can then place it in the boot or footwell of a cool car. We accept no responsibility for any damage sustained to the cake once it has left the premises.
If delivery has been requested, we will deliver the cake on the day set out in the order confirmation to the address provided. Mr Bun The Baker Giltrows Ltd will always do the best it can to ensure delivery dates agreed are achieved for the provision of the goods or services however the Company cannot accept liability for delays. If the delivery address changes after the order has been confirmed additional charges may be added to cover mileage. Mr Bun The Baker Giltrows Ltd cannot offer guaranteed delivery slots or delivery outside of the following areas: Hunstanton, Heacham, Snettisham, Ingoldisthorpe and Dersingham.
Price and Payment
The price of your cake will be as set out in your order confirmation. Any orders under £35 need to be paid in full upon ordering. A non-refundable booking fee is required on all cakes over £35 and is used to secure your booking. The remaining balance must be paid no later than 7 days before collection or delivery. The client is welcome to pay in instalments so long as the full balance is paid within the timeframe stated above.
The balance must be paid in cleared monies no later than the date set out in the order confirmation by bank transfer to the account specified, cash, over the phone, via the website or instore.
If payment is not received by the date specified, we reserve the right to hold the order until payment is made in full or cancel the order. When payment is late, we accept no responsibility should we be unable to purchase the required stock or equipment to make the cake as laid out in the order confirmation. In these circumstances the cake will be made as close to the order confirmation as possible with no liability on Mr Bun The Baker Giltrows Ltd.
It is the responsibility of the client to ensure payment is on time.
Cancellation, postponement and alterations
In the event of a cancellation by yourselves, charges are as follows;
Less than 48 hours = A refund is not permitted.
More than 72 hours = The booking fee will be held and the rest of the balance may be eligible for a refund at Mr Bun The Baker Giltrows Ltd’s discretion.
Mr Bun The Baker Giltrows Ltd will do their best to provide dates for postponement but holds no liability should the date requested not be available.
Alterations may not be able to be made if not enough notice is given. The time scale depends on the extremity of the alterations. If changing the flavour or design, a time scale of 4 days notice is advised. In the case of alterations, a new order confirmation will be issued detailing the changes and the new cost (if any). Should you make any changes there will be no reduction in the price you pay, even if your new design is cheaper than the original booking. Personalised cake toppers are ordered as soon as your booking fee is paid. Therefore, any changes to them will incur an extra fee and will need 9 days notice.
Mr Bun The Baker Giltrows Ltd’s liability in respect of defects in goods or services shall be limited to the issue of a credit note in respect thereof or granting a refund or other such compensatory measures as Mr Bun The Baker Giltrows Ltd, at its discretion, considers appropriate in the circumstances and shall be limited to the to the value of the goods or services giving rise to the claim.
Complaints
Complaints are very rare and due to the amount of work put into each individual cake we take them very seriously. Any issues must be brought to our attention within 24 hours of collection or delivery to give fair opportunity to assess the nature of the complaint.
We accept no responsibility for any damage sustained to the cake once it has left the premises in the hands of the client or third party.
Complaints regarding the decoration of celebration cake can be easily repaired so errors of this nature must be pointed out upon collection so as to give us the opportunity to correct them. If the cake was delivered, the client will need to bring the cake back to be repaired. Once the cake has been accepted, this confirms that decoration is as requested, and no further claims can be made.
Where the complaint is in regard to the quality of the cake then the cake, or remainder of the cake/tier, must be returned to us as soon as possible after cutting and within 24 hours of collection/delivery to ensure that we are able to fairly assess the nature of the complaint.
Both Parties agree to not post any negative information about the other arising any online forum or website without providing the other party with a prior opportunity to resolve any issues amicably.
Please note we can only deal with the client who placed the original order.
General Terms
We reserve the right to use images of your cake for any form of advertising including web-based promotions, brochures, galleries and competitions.
The client will be instructed to read these terms and conditions and confirm they are in agreement. If no confirmation is given, but payment is received, Mr Bun The Baker Giltrows Ltd reserves the right to enter into the above contract with the client.
Mr Bun The Baker Giltrows Ltd holds no responsibility should the client have misread the above, so it is advised to read twice.
